VeloRoo Pty Ltd Terms & Conditions:
VeloRoo Pty Ltd (VRPL) rents bicycles (Rental Bikes), provides bike transport services (VeloRoo-ber) and cycling holidays to its Clients on the following terms: All bookings are made in accordance with the terms and conditions set out below. Because our Terms & Conditions contain legal obligations, we encourage you to read them carefully. They form the basis on which bookings are accepted by VéloRoo Pty Ltd.
Travel Insurance:
It is the responsibility of the Client to acquire adequate travel insurance that covers against loss for cancellation due to illness, loss or damage arising by way of personal injury whilst operating a Rental Bike, unexpected cancellation of a VRPL Cycling Tour, theft, or any other actions of a third party. VRPL does not indemnify you against any loss or damage arising during your participation in a VRPL Cycling Tour.
It is strongly advised that you hold appropriate travel insurance (including medical cover) in order to participate in a VRPL Cycling Tour.
Cyclist insurance is different to travel insurance. In Australia we recommend you join Cycling Australia with the appropriate level of membership to cover for accidents and travel insurance. https://cycling.org.au/membership/insurance
Physical Health
Clients taking part in VRPL Cycling Tours do so at their own risk. Clients accept that VRPL Cycling Tours involve significant physical exertion. If there is any doubt about your fitness or ability to take part in an activity based holiday, you should consult your physician.
Agreement for release of images:
Photographs and/or videos may be taken of clients whilst taking part in VRPL Cycling Tours. Clients consent to the use of any such images by VRPL for promotional purposes
Payment and Booking terms:
Cycling Holidays – Bookings are confirmed once the deposit and completed Booking Form are received. Guided Rides – Bookings are confirmed once the deposit is received.
Deposit: Cycling Holidays – An invoice will be issued to you for the initial deposit.
Balance Due Date for Cycling Tour: The balance will be due 2 months (60 days) before commencement of your VRPL Cycling Tour.
VeloRoo-ber Service: the full balance is required upon booking.
Changes to bookings and Cancellations / Refunds policy:
If VRPL is required to make any changes to the content or terms of a VRPL Cycling Tour before the commencement of the tour, VRPL will notify you as soon as is reasonably practicable. If you are not happy with the changed details you may transfer to another VRPL Cycling Tour without charge, providing that space is available.
If you cancel a booking for any reason after it has been confirmed, cancellation will become effective upon receipt of written notification from you and the relevant cancellation charges will apply.
VRPL reserves the right to cancel a booking or a tour at its absolute discretion. Clients hereby accept and acknowledge VRPL’s right to cancel. In the event that VRPL cancels a booking, we will offer an alternative tour if possible. If it is not possible to offer an alternative tour, or if you do not accept the alternative tour, we will refund all moneys already paid, in full and final settlement of the matter. We will notify you of any cancellation as soon as is reasonably practicable.
Cancellation Charges on advertised tours (If you cancel a Cycling Tour booking)
– Cancellation after receipt of the deposit but prior to 120 days before the trip departure date: 50% of deposit refundable.
– Cancellation within 120 days before the trip departure date, but prior to the balance due date: Deposit is non-refundable. We can transfer your deposit, less any incurred expenses, to another tour date.
– Cancellation after the Balance Due Date but prior to 30 days before trip departure date: 50% of tour cost refundable.
– Cancellation within 30 days of tour commencement: No refund.
Cancellation Charges on custom tours (If you cancel a Custom Cycling Tour booking)
– Cancellation after receipt of the deposit but prior to 120 days before the trip departure date: 50% of deposit refundable, less any incurred expenses.
– Cancellation within 120 days before the trip departure date, but prior to the balance due date: Deposit is non-refundable.
– Cancellation after the Balance Due Date but prior to 30 days before trip departure date: 50% of tour cost refundable.
– Cancellation within 30 days of tour commencement: No refund.
Itinerary Amendments & Changes
Occasionally our itineraries are updated. This may be to accomodate changes in weather, public holidays, common seasonal changes to timetables and transport routes, and unforeseen circumstances.
In the event of a change in itinerary, due to safety or events outside of our control, we will notify you as soon as practicable.
Status of Rental Bicycle:
VRPL will complete an inspection and review of each Rental Bike prior to use. Each Rental Bike is prepared in accordance with the specific order for rental. Each Rental Bike has a service and maintenance program. Each Rental Bike will be supplied to Clients in a properly serviced and operational state, ready to ride.
Equipment Supplied:
Each rental bike is rented with accessories appropriate for that model of bike.
Clipless Pedals & Shoes: Clipless Pedals and shoes are not included as part of the bike hire. Clients are required to bring their own pedals and shoes. VRPL have some styles of pedals for hire. Clients must check for availability and pre book if required.
Clients may supply items such as saddles, computers, water bottles and tools kits for fitting to the Rental Bikes. VRPL is not responsible for any loss or damage to client supplied equipment howsoever occasioned.
Helmets: In Europe it may not be compulsory for bicycle helmets to be worn. However, VRPL company policy requires that you must wear a helmet on all VRPL Cycling Tours. Helmets will be supplied to VRPL Cycling Tour clients unless the Client provides their own.
Obligations of Clients:
It is your responsibility to:
• operate the Rental Bike in a manner appropriate to prevailing road and weather conditions;
• wear suitable clothing for the riding environment and for safety/visibility; and
• familiarise yourself with and adhere to the relevant rules of the road and at all times practice courteous,
safe and law abiding cycling.
Theft of and Damage to Rental Bikes:
Once a Client receives their Rental Bike, the Client is responsible for any and all damage to the Rental Bike, including but not limited to theft. The Client’s responsibility for damage to the Rental Bike extends to damage caused when the bike is not being ridden. Should theft occur, depending on the model of Rental Bike, an amount of up to AUD $3000 will be charged to your credit card for the replacement cost.
Prior to commencement of the rental period, valid credit card details will be required as security for instances of theft and/or damage to the Rental Bike.
Should any damage occur to a Rental Bike, VRPL will obtain a quote for repair/replacement from an experienced bicycle retail outlet. The quoted amount will be charged to your credit card before or after repairs are undertaken.
Liability waiver:
Except for any liability which cannot be excluded by law, VRPL shall not be liable for personal injury, death, damage to property, third party liability or any other loss, accident, delay, inconvenience suffered or sustained in connection with a VRPL Cycling Tour, or any act or omission (whether negligent or not) of VRPL, any person associated with VRPL, the Client or the Client’s agents. Clients must insure against all such possibilities.
Clients acknowledge and agree that VRPL maintains no control over the operation of the Rental Bikes by the Client or any defect in or failure of the Rental Bikes, any vehicle, equipment or instrumentality owned, operated or otherwise by the Client.
Whilst VRPL will exercise reasonable care and skill in performing its obligations owed to Clients, Clients acknowledge that they are aware of and understand the inherent risks involved with cycling, which include but are not limited to physical exertion, riding on roads shared with motor vehicles, forces of nature, accidents, travel via any mode of transport, inadequacy of medical facilities, or negligence (other than willful or fraudulent) on the part of VRPL any person associated with VPRL, including its employees and agents. Clients agree to be responsible for their own welfare. Clients taking part in VRPL Cycling Tours do so at their own risk and hereby release VRPL and its agents and employees from and against any and all liability arising during the rental period.
Clients agree that the terms herein are binding on them, their family members, heirs, successors, assigns, dependents and/or minors accompanying them, and their legal representatives.
Clients acknowledge and agree that VRPL and its agents have the right to refuse participation by any person judged incapable of activities, and for not executing required documentation. Any dispute arising out of these matters whatsoever, shall be resolved in binding arbitration/adjudication under the laws of the country of Australia. Any part of this document found to be void or unenforceable shall not negate the enforcement of the remainder.
VRPL reserves the right to refuse continued participation of a Client in a VRPL Cycling Tour if his or her conduct is disruptive and/or affecting the enjoyment of other Clients without any obligation to refund or make alternative arrangements. VRPL cannot be held liable for any loss or additional expense incurred by a Client as a result of their further participation in a VRPL Cycling Tour being refused.
Completing the VéloRoo Booking Form and paying the deposit acknowledges acceptance of these terms.
